Financing

 

 Financing and arranging the financing of the proposal will often be the most difficult element of any purchase or sale. The financial element of the project may often be the most onerous aspect from a purchasers point of view and if your of mind to do so having an early consultation can be instructive and once you have agreed a term with a Bank or Building Society Local Authority or Credit Union they will typically issue their letter of loan offer to you, whereupon we will be able to deal with all aspects of the placing of security by way of mortgage, collateral mortgage or re-mortgage.

What abut tax?

You may wish to speak to us about the tax aspect of the project including the Capital Acquisition Tax (shorthand CAT) (otherwise known as ‘gift tax’ or ‘inheritance tax’). In addition there may be Capital Gains Tax consequences to a sale for vendor.

It is vital for resident and non- resident vendors alike to understand the tax implications of a sale or disposal of Irish real estate and assets and in particular for non- resident vendors to understand the complication and time frames involved in obtaining the necessary tax clearances so that net proceeds of sales can be remitted to a vendor. Therefore early consideration and planning of a transaction can set realistic expectations and allow a vendor to plan accordingly. Knowledge is power.

If you’re giving or getting a site to/from a family member or friend for free or for a reduced consideration or price relative to the open market value you should contact us early in the discussions so that we can advise you on the tax consequences and how best to proceed to make the transaction as tax efficient as possible.
